Privacy policy

Last Updated: October 1, 2026

This Privacy Policy explains how OTR Performance, Inc. ("OTR Performance," "we," "us," or "our") collects, uses, and shares personal information through our website and online store, the OTR Diagnostics app and OTR Link adapter, OTR Remote hardware, OTR Cloud, OTR Assist, and our web and mobile apps (together, the "Services"). Capitalized words not defined here have the meanings given in our Terms of Service.

1. Who this covers

This policy covers visitors to our website, people who buy from our store, our customers and their Authorized Users (such as fleet managers and technicians), and drivers and other people whose information reaches the Services through a Vehicle. Drivers do not use OTR Remote themselves. Information about them reaches us only through the Vehicles they operate.

2. Our role

2.1 Fleet data. When a business customer (a "fleet") uses the Services with its Vehicles, the fleet decides why and how data from those Vehicles is used, and we process it on the fleet's behalf and under our agreement with the fleet. If you drive for a fleet, contact the fleet first about your data. We will help the fleet respond.

2.2 Our own data. We decide how to use the information we collect to run our website, store, accounts, billing, support, security, and marketing. We also decide how to use the De-identified Data we create.

3. What we collect

3.1 Information you give us. Name, company, email, phone number, billing and shipping address, account and sign-in details, roles, messages to support, and survey or feedback answers. Payment card details are collected and stored by our payment processors, not by us.

3.2 Vehicle data. Vehicle identification number, engine and aftertreatment readings, fault codes, settings, Vehicle Commands and Vehicle Setting Changes and their results, and other diagnostic information.

3.3 Location. For OTR Remote, the precise GPS position, speed, and trip and route history of the Vehicle.

3.4 User activity. The actions Authorized Users take in the Services, including sign-ins, Vehicle Commands, Vehicle Setting Changes, and the Acknowledgments given for them.

3.5 Device data. Adapter identifiers, firmware version, cellular signal and connection data, Bluetooth connection data between the OTR Link adapter and your phone, and phone or browser type, operating system, and app version. Our Android app asks for the location permission because Android requires it to scan for Bluetooth devices.

3.6 Photos, video, and audio you choose to send. If you use the camera, microphone, or photo library in the OTR Diagnostics app to send troubleshooting photos, video, or audio, we receive what you send. The app asks for your permission first.

3.7 Usage and diagnostics data. How you use our website and apps, such as pages viewed, clicks, errors, and crash reports, collected through the tools described in Section 6.

3.8 From others. Information from fleets about their users and Vehicles, from resellers and partners, and from our service providers.

4. How we use information

We use information to:

  • provide, operate, and support the Services, including showing fleets the health and location of their Vehicles.
  • send the Vehicle Commands and Vehicle Setting Changes that users request, and keep Change Records.
  • process orders, payments, shipping, returns, and warranty claims.
  • secure the Services, prevent fraud and misuse, and investigate incidents.
  • understand how the Services are used, fix problems, and improve and develop our products.
  • create De-identified Data, which cannot reasonably identify any person, and use it to train and improve machine learning models, build diagnostics and benchmarks, and publish industry insights.
  • communicate with you about your account, orders, service changes, and, where allowed, marketing, which you can opt out of at any time.
  • comply with law, respond to lawful requests, and establish, exercise, or defend legal claims.

5. How we share information

5.1 With the fleet. Information about a fleet's Vehicles, including their location, and about its users is available to that fleet's Authorized Users.

5.2 With service providers. We share information with companies that help us run the Services under contracts that limit their use of it, including cloud hosting, cellular carriers, mapping, payment processing, our online store platform, email and messaging, customer support, analytics, error reporting, and AI model providers.

5.3 With advertising partners. Our website and store use advertising cookies and pixels from Google and Meta, as Section 6 describes. Those partners receive information about your visits, such as pages viewed and actions taken, and may use it to show you our ads on other sites.

5.4 For legal reasons. We may share information when we believe in good faith that the law requires it, to protect the safety of any person, or to protect our rights and the security of the Services.

5.5 Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this policy.

5.6 With your permission. We share information in other ways when you tell us to.

5.7 What we do not do. We do not sell personal information for money. We do not sell or share information collected through OTR Remote, OTR Diagnostics, or OTR Cloud. We do not share mobile phone numbers or text message consent with third parties for their marketing.

6. Cookies, analytics, and error reporting

Our website and web app use cookies and similar tools. Our store runs on Shopify, which sets cookies needed for the cart and checkout. Our website and store also use Google Analytics, Google Ads, the Meta Pixel, and Klaviyo to measure visits, show our ads on other sites, and send marketing emails you sign up for. Our web app uses Google Tag Manager, Google Firebase Analytics, Hotjar, and Sentry to understand how the app is used and to find and fix problems. Some of these tools record how a page is used, such as clicks, scrolling, and page views, and Sentry may capture a replay of a session, for example, when an error happens. These recordings may include what appears on the screen. You can opt out of advertising cookies through your browser settings, through Google and Meta ad settings, or by using Global Privacy Control. We treat a Global Privacy Control signal from your browser as a request to opt out of the sale or sharing of your personal information. We do not respond to Do Not Track signals. Our mobile apps use Google Firebase Analytics, Crashlytics, Performance Monitoring, and Remote Config to measure use, report crashes, and adjust app settings.

7. How long we keep information

We keep personal information only as long as we need it for the purposes in this policy, to meet legal obligations, and to resolve disputes. In general:

  • Account and Vehicle data: while the account is active, and for 90 days after it ends so it can be exported. We then delete it or convert it into De-identified Data.
  • Change Records and records of who accepted our Terms: as long as needed to establish, exercise, or defend legal claims, and as the law requires.
  • Website, marketing, and analytics data: until you unsubscribe or the cookie expires, and no longer than we need it.
  • Support records: as long as needed to resolve the issue and handle any warranty claim.
  • Order and billing records: as long as tax and accounting law requires.
  • Backups: overwritten on their normal cycle.

8. Security

We use administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee the security of information.

9. Your rights and choices

9.1 Your rights. Depending on where you live, you may have the right to know what personal information we hold about you, to access, correct, delete, or receive a copy of it, to opt out of certain uses, to limit the use of sensitive personal information (such as precise location), and to withdraw your consent where we rely on it. We will not treat you differently for using these rights.

9.2 How to make a request. Email legal@otrperformance.com with the subject line "Privacy Request," or call (586) 799-4375. We will verify your request before acting on it. You may use an authorized agent where the law allows. If we deny your request, you may appeal by replying to our decision.

9.3 Drivers and fleet users. If your information reaches us through a fleet, we may send your request to the fleet, which decides how it is handled.

You can opt out by emailing legal@otrperformance.com with the subject line "Do Not Sell or Share," or by using Global Privacy Control. We do not sell or share information collected through OTR Remote, OTR Diagnostics, or OTR Cloud, and we do not knowingly sell or share the personal information of anyone under 16.

9.6 Sensitive personal information. We use sensitive personal information only to provide the Services and for other purposes the law permits, and not to infer characteristics about you.

9.7 Canada. Canadian residents have rights under the Personal Information Protection and Electronic Documents Act and provincial law, including Quebec's Act respecting the protection of personal information in the private sector. Our person in charge of the protection of personal information is our Privacy Officer, who can be reached at legal@otrperformance.com.
